CRITICAL SAFETY INFORMATION (READ FIRST)

WARNING: USE OF SALTY BARREL HOT TUBS PRODUCTS INVOLVES SERIOUS RISKS, INCLUDING BUT NOT LIMITED TO:

  • DROWNING

    • Children and pets can drown if left unsupervised.

    • Children under 18 must be supervised by a competent adult at all times when using the hot tub or related products.

    • Our products are not designed or recommended for use by children.

    • Comply with all local safety barrier requirements (fences, covers, alarms, etc.).

  • BURNS & SCALDING

    • Do not exceed a maximum water temperature of 104°F (40°C).

    • Overheating may cause burns, heat exhaustion, or other serious injuries.

    • Prolonged exposure to water above 37°C (99°F) can cause overheating or other injuries. Limit soaks to 15 minutes and allow sufficient cool-down breaks.

  • FIRE & HEAT HAZARDS

    • Wood-fired and open-flame heating coils pose a risk of burns and fire.

    • Use only approved fire sources; never place flammable materials near the hot tub or heating elements.

    • Monitor heating at all times.

  • STRUCTURAL FAILURE / INSTALLATION RISKS

    • Improper setup or use may lead to product damage, collapse, or personal injury.

    • Always follow the Owner’s Manual provided with each product.

    • Seek professional help if uncertain about installation or usage.

  • ALCOHOL & DRUG USE

    • Do not use the hot tub while under the influence of alcohol or drugs. Impaired judgment increases drowning and injury risks.

BY PURCHASING AND/OR USING OUR PRODUCTS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE RISKS AND ASSUME FULL RESPONSIBILITY FOR ANY INJURIES OR DAMAGES RESULTING FROM IMPROPER INSTALLATION, MISUSE, OR FAILURE TO FOLLOW SAFETY GUIDELINES.

 

1. OVERVIEW

This website (the “Site”) is operated by Salty Barrel Hot Tubs Pty Ltd (“Salty Barrel Hot Tubs,” “we,” “us,” or “our”). By accessing our Site and/or purchasing any products or services (collectively, the “Service”), you (“you” or “the user”) agree to these Terms of Service (“Terms”). If you do not agree with any part of these Terms, do not use our Site or purchase our products.

  • Scope
    These Terms apply to all Site visitors, customers, and contributors of content.

  • Updates
    We reserve the right to modify these Terms at any time by posting updates on this page. Continued use of our Site after changes are posted constitutes acceptance of the modified Terms.

 

2. AGE REQUIREMENTS & SUPERVISION

  • Age of Majority
    You represent that you are at least the age of majority in your jurisdiction. If you are under the age of majority, you may only use this Site with the consent and direct supervision of a parent or legal guardian.

  • Children Under 18
    Our products are not intended for unsupervised use by minors under 18. Any use by minors must be under the direct supervision of a responsible adult.

  

3. ASSUMPTION OF RISK & LIMITATION OF LIABILITY

  • Acknowledgment of Risks
    By purchasing, installing, or using our products, you acknowledge the inherent risks including, but not limited to, drowning, burns, fire, structural failures, and injury from improper setup or usage.

  • No Liability for Misuse or Non-Compliance
    Salty Barrel Hot Tubs is not responsible for injuries, damages, or losses resulting from:

    • Failure to follow safety guidelines or warnings, including those in the Owner’s Manual.

    • Improper installation, maintenance, or use of our products.

    • Non-compliance with local laws, building codes, or safety regulations.

    • Use by minors without appropriate adult supervision.

  • Indemnification
    You agree to indemnify and hold harmless Salty Barrel Hot Tubs, its directors, officers, employees, agents, contractors, suppliers, and service providers from any claims, damages, or expenses (including attorneys’/legal fees) arising out of or related to:

    • Your use or misuse of our products or Services.

    • Your breach of these Terms.

    • Violation of any law or the rights of a third party.

  • Disclaimer of Warranties
    To the fullest extent permitted by law, our products and Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties or conditions of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Except as expressly stated in our Limited Lifetime Warranty (Section 6), these disclaimers remain in effect.

  • Limitation of Damages
    In no event shall Salty Barrel Hot Tubs be liable for any direct, indirect, incidental, punitive, special, or consequential damages, including, but not limited to, personal injury, property damage, lost profits, loss of data, or replacement costs.

    • If applicable law does not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.

 

4. PRODUCT SAFETY & COMPLIANCE

  • Owner’s Manual & Safety Instructions

    • Each product ships with an Owner’s Manual containing detailed safety guidelines, installation procedures, and maintenance requirements.

    • It is your responsibility to read, understand, and follow all instructions.

  • Temperature Limit

    • Do not exceed a maximum water temperature of 104°F (40°C) to avoid scalding, heat stroke, or other injuries.

    • Regularly monitor water temperature with a reliable thermometer.

  • Local Laws & Regulations
    You are solely responsible for ensuring compliance with all applicable local laws, regulations, and building codes, including those related to fencing, gates, covers, and water safety.

  • Child Safety

    • Children must never be left unattended in or near the hot tub.

    • Failure to properly supervise minors may result in serious injury or death, and Salty Barrel Hot Tubs disclaims any liability for injuries arising from inadequate supervision.

  • Fire & Heating Elements

    • Use only appropriate heat sources and monitor any open flame or heat source at all times.

    • Keep flammable materials away from the hot tub and heating coils.

  • Alcohol & Drug Use

    • Operating or using the hot tub under the influence of alcohol or drugs is strongly discouraged, as it increases the risk of drowning, burns, and other injuries.

  

5. ORDERS, BILLING, AND PAYMENT

  • Order Acceptance
    We reserve the right to refuse or cancel any order for any reason, including suspected fraud or unauthorized resale.

  • Pricing & Availability

    • All prices are subject to change without notice.

    • We do our best to keep product availability updated but cannot guarantee stock at all times.

  • Billing Information
    You agree to provide accurate and complete billing and contact information, including email, shipping address, and payment details, and to update them promptly if they change.

  • International Orders

    • Buyers are responsible for any customs duties, import taxes, or fees imposed by their jurisdiction.

    • Products shipped internationally must still comply with local regulations; you assume responsibility for ensuring legal import and safe usage.

 

6. RETURNS, REFUNDS, AND LIMITED WARRANTY

Returns & Refunds

  • Returns are accepted only for unused, undamaged products in their original packaging, subject to our inspection.

  • Any refund will be processed according to our Refund Policy, which may include restocking fees and exclude shipping costs.

Limited Warranty

Our products come with a limited warranty covering manufacturing defects only.
This limited warranty does not cover damage from misuse, improper installation, unauthorized modifications, or failure to follow instructions.

Limited Lifetime Warranty (Effective for Products Purchased on or after February 25, 2025)

  • Coverage & Duration

    • Under normal use, we offer a limited lifetime warranty (“Lifetime Warranty”) on all covered components (expected product lifetime of 20 years).

    • This Warranty applies only to the original purchaser and is non-transferable.

  • What Is Covered

    • All components that break or fail under normal use and proper maintenance.

    • Excludes cosmetic wear, minor discoloration, or normal material degradation.

  • Exclusions

    • Damage caused by misuse, neglect, improper installation, unauthorized modifications, or failure to follow the Owner’s Manual.

    • Damage caused by allowing water to freeze inside the heating coil (ice expansion) or ‘dry firing’ the coil (operating the heating coil without sufficient water).

    • Damage resulting from commercial use or rental use.

    • Coverage does not extend to normal wear and tear, acts of nature, or any issues arising from ignoring required maintenance.

  • Remedy: Replacement Parts Only

    • We will send a replacement part for any covered breakage at our discretion.

    • Replacement parts are the sole remedy under this Lifetime Warranty; no refunds or credits will be issued.

  • Shipping & Return of Broken Parts

    • Customers must pay all shipping costs for replacement parts.

    • At our discretion, we may require you to return the broken or defective part (at your expense) for inspection.

  • Proof of Purchase & Claim Procedure

    • You must provide proof of purchase (e.g., receipt or order ID) to file a claim.

    • Contact us at contact@saltybarrelhottubs.com with details, photos, or other evidence of the damage.

  • Limitations & Consumer Law

    • Except as stated in this Limited Lifetime Warranty, all other warranties (express or implied) are disclaimed to the fullest extent permitted by law.

    • Nothing in this Warranty excludes or restricts any non-excludable statutory consumer protections (e.g., under Australian Consumer Law).

Warranty Claims

To initiate a warranty claim (including claims under the Limited Lifetime Warranty), contact us at contact@saltybarrelhottubs.com with proof of purchase and detailed photos or evidence of the defect.
We will assess whether the issue is covered under our warranty policies. If covered, we may repair, replace, or issue a credit at our sole discretion, subject to the terms outlined above.

For more details on our return process and any additional terms, please refer to our separate Refund Policy. In the event of any conflict between the Refund Policy and these Terms, these Terms will govern to the extent permitted by law.

  

7. WEBSITE USE & PROHIBITED ACTIVITIES

  • Site Content

    • All text, images, logos, and other content on the Site are the intellectual property of Salty Barrel Hot Tubs unless otherwise noted.

    • Unauthorized use of our intellectual property is prohibited.

  • Prohibited Activities
    You agree not to use the Site or its content for:

    • Any unlawful or fraudulent purpose.

    • Infringing upon our intellectual property rights or those of others.

    • Uploading or transmitting malicious code (viruses, worms, etc.).

    • Collecting personal data of others without consent.

    • Any obscene or immoral purpose.

    • Violating any international, federal, or local regulations.

  • Site Modifications
    We may modify or discontinue the Site (or any part of it) without notice, and we are not liable for any such modification, suspension, or discontinuation.

 

8. PRIVACY POLICY

Your submission of personal information to us is governed by our Privacy Policy. We do not store or process credit card details directly; payments are securely handled by our third-party payment processors.

 

9. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

  • No Guarantee of Uninterrupted Service
    We do not guarantee that your access to the Site will be uninterrupted, secure, or error-free.

  • As Is / As Available
    The products and Services are provided “as is” and “as available,” without warranties or conditions of any kind, either express or implied. Except as expressly provided in our Limited Lifetime Warranty, this disclaimer remains in effect.

  • Maximum Extent of Liability
    Where certain jurisdictions do not allow the exclusion or limitation of liability, our liability shall be limited to the fullest extent permitted by law.

 

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Salty Barrel Hot Tubs, its parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand—including reasonable attorneys’/legal fees—arising out of your breach of these Terms, your misuse of our products, or your violation of any law or the rights of a third party.

 

11. SEVERABILITY

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision remains enforceable to the fullest extent permitted by law, and the unenforceable portion will be deemed severed. Such a determination does not affect the validity of the remaining provisions.

 

12. TERMINATION

  • Survival of Obligations
    All obligations and liabilities incurred prior to termination survive for all purposes.

  • Termination by You
    You may terminate these Terms by ceasing to use our Site and Services.

  • Termination by Us
    If we suspect you have violated any provision of these Terms, we may terminate your access immediately without notice, and you remain liable for any amounts due up to and including the date of termination.

 

13. ENTIRE AGREEMENT

These Terms, together with any policies or operating rules posted by us (including our Privacy Policy and Refund Policy), constitute the entire agreement between you and Salty Barrel Hot Tubs. They supersede any prior or contemporaneous agreements or communications, whether oral or written.

 

14. GOVERNING LAW & JURISDICTION

  • Governing Law
    These Terms and any separate agreements with us shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to conflict-of-law principles.

  • Jurisdiction
    Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia, unless otherwise required by applicable consumer protection laws in your place of residence.
